⚠️ Alpha Testing Disclaimer
Kobold Kronikler is currently in alpha testing. By accessing and using this Service, you acknowledge and agree to the following additional terms:
- No Warranties. The Service is provided “as is” and“as available” without any warranties of any kind. The Service is in early development and may contain bugs, errors, incomplete features, and security vulnerabilities that have not yet been identified or resolved.
- No Personal Information. You are strongly advised not to provide any real personal information, including your real name, real email address, physical address, or phone number. Use pseudonyms and non-primary email addresses.
- Data Loss & Resets. All data stored in this Service is subject to deletion, corruption, or loss at any time without notice. Database resets may be performed during the alpha phase.
- No Affiliation. This Service is operated by an individual and is not affiliated with, endorsed by, or associated with any company, organisation, or legal entity.
- Use at Your Own Risk. To the maximum extent permitted by applicable law, the operator shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of or inability to use the Service. Nothing in this disclaimer excludes or limits liability that cannot be legally excluded under applicable law (including liability for wilful misconduct or gross negligence under German law, §§276, 278 BGB).
- No Availability Guarantees. The Service may be taken offline, modified, or discontinued at any time without prior notice.
This alpha disclaimer supplements the Terms below. In case of conflict, the more restrictive provision applies.
1. Scope and Parties
These Terms of Service (“Terms”) govern your access to and use of the Kobold Kronikler web application and all associated services (collectively, the “Service”), operated from Germany. By registering for or using the Service, you enter into a binding agreement with the operator identified in the Impressum (“we”, “us”, or “our”).
If you do not agree to these Terms, you must not use the Service.
2. Minimum Age
The Service is intended for users who are at least 16 years of age. In accordance with Article 8 of the General Data Protection Regulation (GDPR) and §25 of the German Federal Data Protection Act (BDSG), users under 16 may not register without verifiable parental or guardian consent. By registering, you confirm that you meet this age requirement.
3. Description of the Service
Kobold Kronikler is a cloud-based (SaaS) campaign management tool for tabletop role-playing game (TTRPG) Game Masters (“GMs”) and their players. The Service allows GMs to create and manage campaigns, world events, news, plots, milestones, and player characters. Players may access their assigned campaign to view content shared by their GM.
The Service is currently provided free of charge during an early-access phase. We reserve the right to introduce paid tiers or features in the future; any such changes will be communicated in accordance with Section 10.
4. Registration and Account
Access to the full Service requires creating an account. You agree to:
- Provide accurate and complete registration information, including a valid email address.
- Keep your login credentials confidential and not share them with third parties.
- Notify us immediately of any unauthorised use of your account.
- Take responsibility for all activities that occur under your account.
We reserve the right to refuse registration or to disable an account where there is suspicion of fraud, abuse, or violation of these Terms.
5. Permitted Use and User Obligations
You agree to use the Service only for its intended purpose and in compliance with all applicable laws and regulations. You must not:
- Use the Service for unlawful, abusive, harassing, defamatory, or fraudulent purposes.
- Upload or transmit content that infringes third-party intellectual property rights.
- Attempt to gain unauthorised access to our systems or other users’ data.
- Attempt to reverse-engineer, decompile, disassemble, or otherwise derive the source code of the Service.
- Introduce viruses, malware, or other harmful code.
- Scrape, harvest, or systematically extract data from the Service without our prior written consent.
- Resell, sublicense, or otherwise commercially exploit the Service without our prior written consent.
6. User Content
You retain ownership of all content you create within the Service (campaigns, notes, events, and similar material; “User Content”). By uploading or submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free licence to store, process, and display that content solely to the extent necessary to provide and maintain the Service.
You are solely responsible for the legality, accuracy, and appropriateness of your User Content. We do not routinely monitor User Content but reserve the right to remove content that violates these Terms or applicable law.
7. Intellectual Property
All software, design, text, graphics, logos, and other materials forming part of the Service (excluding User Content) are the property of the operator or our licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any intellectual property right to you.
8. Availability and Service Changes
We strive to provide a reliable Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, technical issues, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue features of the Service at any time. For material changes that affect existing functionality, we will give reasonable advance notice where practicable.
9. Data Protection
We process personal data in accordance with the EU General Data Protection Regulation (GDPR) and applicable German data protection law. For full details on what data we collect, the legal basis for processing, your rights, and how to exercise them, please refer to our Privacy Policy.
10. Amendments to These Terms
We may amend these Terms from time to time. Where changes are material, we will notify registered users by email or via a prominent notice within the Service at least six (6) weeks before the amended Terms take effect.
If you do not agree to the amended Terms, you may terminate your account before the effective date of the changes. Continued use of the Service after the effective date constitutes acceptance of the amended Terms. Minor editorial or clarificatory changes that do not affect your rights may be made without prior notice.
11. Termination
By you: You may terminate your account at any time by contacting us at the address listed in the Impressum. Upon termination, your account and associated data will be deleted in accordance with our Privacy Policy.
By us: We may suspend or terminate your access with immediate effect if you materially breach these Terms and, where the breach is capable of remedy, fail to remedy it within seven (7) days of written notice. We may also terminate the Service entirely on reasonable advance notice.
12. Limitation of Liability
To the maximum extent permitted by applicable law, our liability for damages arising from or related to the Service is limited to cases of intent (Vorsatz) and gross negligence (grobe Fahrlässigkeit). For slight negligence (einfache Fahrlässigkeit), our liability is excluded except where an essential contractual obligation (wesentliche Vertragspflicht / Kardinalpflicht) has been breached, in which case liability is limited to typically foreseeable damage.
Nothing in these Terms limits or excludes our liability for:
- Death or personal injury caused by our negligence;
- Fraud or fraudulent misrepresentation;
- Any liability that cannot be disclaimed under mandatory applicable law.
As the Service is currently provided free of charge, our total aggregate liability for claims arising in any twelve-month period shall not exceed EUR 100, except in the cases listed above.
13. Disclaimer
The Service is provided “as is” and “as available” without warranty of any kind except as expressly set out in these Terms or required by mandatory law. In particular, we do not warrant that the Service will be error-free, uninterrupted, or free from data loss, although we take reasonable measures to prevent such occurrences.
14. Links to Third-Party Websites
The Service may contain links to third-party websites. Such links are provided for convenience only; we do not endorse or control those websites and are not responsible for their content or privacy practices. Use of any linked website is at your own risk.
15. Online Dispute Resolution
The European Commission provides an Online Dispute Resolution (ODR) platform for consumers and traders to resolve disputes out of court. You can access the platform at: https://ec.europa.eu/consumers/odr
We are not obligated to participate in a consumer arbitration procedure before a consumer arbitration board and do not currently do so voluntarily.
16. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, excluding its conflict-of-laws provisions and excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
For disputes arising from or related to these Terms, the courts of Germany shall have exclusive jurisdiction, subject to any mandatory jurisdiction rules applicable in your country of residence. If you are a consumer habitually resident in another EU member state, you also retain the protection of the mandatory consumer-protection provisions of your country of residence.
17. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service.
